1. Overview

These Terms of Service govern all services provided by Fighting Kiwi ("the Company"), operated by Jackson, based in Kamloops, British Columbia, Canada. By booking, hiring, or engaging Fighting Kiwi for any service, you ("the Client") agree to the following terms in full.

2. Services

Fighting Kiwi provides the following professional services: Film Production, Photography, Creative Direction, and Media Production. The specific scope of work for each project will be outlined in a separate project agreement, quote, or contract provided prior to the commencement of work.

3. Project Agreements & Scope

All projects begin with a written agreement detailing the scope of work, deliverables, timelines, and agreed pricing. Any changes to the scope of work requested after the agreement is signed may result in additional fees and adjusted timelines. Fighting Kiwi reserves the right to decline scope changes that fall outside the original project parameters.

4. Payment Terms

Payment structures are determined on a per-project basis and will be clearly outlined in the project agreement. Fighting Kiwi reserves the right to withhold final deliverables until payment has been received in full. Overdue payments may result in work being paused or cancelled. Any additional costs incurred during production (travel, equipment rentals, location fees, etc.) will be communicated to the Client in advance and are the responsibility of the Client unless otherwise agreed in writing.

5. Deposits & Cancellations

Where a deposit is required, it is non-refundable unless Fighting Kiwi cancels the project. If the Client cancels a project after work has commenced, Fighting Kiwi reserves the right to retain any deposit and invoice for work completed up to the point of cancellation. Cancellations must be submitted in writing.

6. Revisions

The number of revisions included in a project will be specified in the project agreement. Revision requests beyond the agreed number may be subject to additional fees. Revisions must be requested within a reasonable timeframe following the delivery of draft materials.

7. Intellectual Property & Copyright

Upon receipt of full payment, the Client is granted a license to use the delivered content for its intended purpose as outlined in the project agreement. Fighting Kiwi retains the right to use any produced content for portfolio, marketing, and promotional purposes unless the Client requests otherwise in writing prior to the start of the project. All raw files, unedited footage, and original project files remain the property of Fighting Kiwi unless explicitly agreed otherwise.

8. Client Responsibilities

The Client is responsible for providing accurate information, timely feedback, and any necessary access, materials, or permissions required to complete the project. Delays caused by the Client may affect project timelines and deadlines. Fighting Kiwi is not liable for project delays resulting from a lack of Client cooperation or communication.

9. Limitation of Liability

Fighting Kiwi's liability is limited to the total amount paid by the Client for the specific project in question. Fighting Kiwi is not liable for any indirect, incidental, or consequential damages arising from the use of delivered content. In the event of equipment failure, unforeseen circumstances, or events beyond our control, Fighting Kiwi will make every reasonable effort to remedy the situation but cannot be held liable for losses outside of our control.

10. Confidentiality

Fighting Kiwi agrees to keep all sensitive business information shared by the Client confidential and will not disclose it to third parties without written consent, except where required by law.

11. Governing Law

These Terms of Service are governed by the laws of the Province of British Columbia, Canada. Any disputes arising from these terms shall be subject to the jurisdiction of the courts of British Columbia.

12. Changes to These Terms

Fighting Kiwi reserves the right to update these Terms of Service at any time. Changes will be reflected by the updated date at the top of this page. Continued engagement with Fighting Kiwi following any updates constitutes acceptance of the revised terms.
